The Workflow between the urf Courts and Shari'a Courts in the Recent Qajar Period, Based on the Archives of the Divan Adliyee Azam (1904)

Abstract

Purpose: In the present study, based on the two collections of archival documents of the Adliyee Azam(around 1322 AH), the relations between the two organizations are documented and remapped. The question is that the process of reforming justice has changed the relations between the two legal and judicial sections. Or more in public law?
Methodology and Research Design: This research has been conducted with the historical study method of two judicial institutions in the thirteenth century and the analysis of administrative papers and archival documents.
Findings and Conclusion: According to available data, it can be said that despite changes in the legal doctrines and regulations imposed by the government, restrictions were imposed on the limits of the powers of the Shari'a courts, but the structure and the set of privileges remained until the Constitutional Faith.
